KESGRAVE TOWN COUNCIL Planning and Development Committee Minutes Minutes of the Meeting of the Planning and Development Committee held on the 19th June 2017 in the Council Chamber, Kesgrave Town Council

1. Welcome and Apologies for Absence – The Chairman welcomed those present to the Meeting. An apology for absence was received from Councillor Archer as he is attending the SALC (Suffolk Association of Local Councils) Area Meeting and Councillor Hamilton. Councillor Wallace was not present and did not send his apologies for absence.

2. Declaration of Interests – There were no declarations of interest made.

3. Minutes of the Last Meeting held on the 5th June 2017 – These Minutes were received, considered and approved by the Committee, following the vote. (Copy in Minute Book).

4. Clerks Report/Update/Matters Arising – The Committee noted the following:- Minute Number 7 – DC/17/2065/FUL – 1 St Lawrence Green – Single storey rear/side extension and side extension at first floor level and associated alterations – The Committee recommended refusal on this proposal at its last Meeting on the 5th June 2017. It noted the copy objection letter from two local residents on the grounds that the single storey side/rear extension will not be in character with the current street scene and that the proposed dropped kerb will mean a loss of on-street parking for other residents in this area. Councillor Derrick arrived at this point of the Meeting.

5. Members of the Public – Members of the Public spoke about their respective concerns relating to DC/17/2224/OUT – 165 Main Road – Outline Application – Use of land for the erection of two dwellings with associated garaging/parking (existing singlestorey annex to be demolished). Construction of access drive. Objections from the public present were on the grounds of infrastructure pressures and the sewerage works/station and unpleasant smells omitting from this area, together with other infrastructure issues relating to drainage and flooding and vehicular access concerns, together with associated noise, reassurances about hedges and boundaries being retained. 2

6. Copy Letters of Objection/In Support/Observations – The Committee noted that there were no letters received apart from those under Minute Numbered 4.

7. Schedule of Applications/Proposals – The Committee considered and made its formal comments/recommendations to the Local Planning Authority – (LPA). (Copy in Minute Book). All Members of the Public left the Meeting following the Committee’s recommendation for refusal of the first item on this Schedule.

8. Schedule of Planning Decisions – The Committee noted the updates. (Copy in Minute Book).

9. Referral to Planning Committee of the LPA (Local Planning Authority) as opposed to Officer Delegated or The Planning Inspectorate – The Committee noted that there were no updates.

10. Public Inquiry – Appeal Reference: APP/J3530/W/16/3160194: Land to The East of Bell Lane – The Committee noted that there were no recent updates. It was noted that Councillors Mills and Patten have liaised with local resident Mr J Ogden (previously a Town Councillor), who had put together a paper. Councillor Patten has also liaised with the Clerk with regard to the formal responses from the Town Council.

11. Kesgrave Neighbourhood Plan Working Party – The Committee noted that the Working Party met on the 7th June 2017. They noted the success of the Neighbourhood Plan Stall at the Big Lunch/Kesgrave Fun Day which was held on the 10th June 2017. The Working Party will meet again on Thursday 22nd June 2017 at 6.30pm at the Town Council offices. The Committee noted the final arrangements for the public engagement sessions which will take place on Tuesday 4th July 2017 at the Kesgrave Scout Hall from 7pm – 9pm, Thursday 6 th July 2017 at the Millennium Jubilee Hall (MJH) from 7pm – 9pm and Saturday 8th July 2017 at the Baptist Church Hall from 10am – 12 noon. Councillor Patten asked for Officer resourcing to be considered under the confidential part of the 24th July 2017 full Town Council Meeting, in order to progress the Kesgrave Neighbourhood Plan further. This was agreed by the Committee, following the vote.

12. Adastral Park Development, Martlesham Heath (CEG Planning Application) – Councillors noted that Councillor Patten will be meeting with Martlesham Parish Council regarding this development and air quality matters relating to both Martlesham and Kesgrave. It was noted that the LPA and its designated Officer will continue to keep the Town Council updated as this application/development progresses.

13. Enforcement – Breach of Planning Permission – 79 Dobbs Lane – The Committee raised its grave concerns regarding this breach of planning. The construction of the build bears no relationship to the plans and permission granted in terms of size, dimensions, location or plan style. Different materials have been used and windows have been inserted where none were authorised. It is a clear breach of the regulations. It noted that the Enforcement Officer has agreed that numerous elements of the built form differ from the planning permission. The Enforcement Officer has written to the applicant and advised that they do not have planning permission for what has been built and has requested that if a retrospective application has not been submitted within 28 days, that the LPA will take steps to enforce against these breaches. 3 The LPA has further advised that if the application is submitted and refused by Officers, the applicant would have a right of appeal to the planning inspectorate. The LPA has also advised the relevant complainants of the Council’s action and will provide a further update after the 28 days period.

14. Date of Next Meeting – The next Planning and Development Committee Meeting will be held on Monday, 3rd July 2017 at 6.15pm.

15. Agenda Items for Next Meeting – Members had no requests for items to discuss at the next Meeting. There being no other business, the Meeting closed at 6.57pm.
